Terms & Conditions

PRICES – The prices shown in the catalog are subject to change without notice. Items will be invoiced at the current rate on the date of shipment.

TERMS – We kindly accept MasterCard and Visa credit cards or Cash With Order. COD shipments are accepted on a case-by-case basis. Certified Check may be required on COD shipments. If you prefer we will mail or fax you an invoice for prepayment.

FREIGHT – Any quote for freight is an estimate only and may change at invoice. Orders are shipped UPS, FED EX or common carrier. All orders will be shipped ground unless otherwise specified. Check shipments upon receipt and notify the shipping agent of any damage when signing for your shipment BEFORE taking delivery. All orders are F.O.B. from Etowah Valley Equipment or the manufacturer. All damage claims are the responsibility of the carrier. Our liability for damage ceases when the carrier receives the order from us.

MERCHANDISE – Inspect shipments upon receipt. Obtain written notation of missing or damaged merchandise from the carrier. All shortages, lost or damaged product or errors must be reported within 7 days. Shipments due to error will be shipped UPS Ground only.

RETURNS – No returns after 45 days. All returned parts must be in new and unused condition. A missing item or damaged product fee will be charged on any returned item missing the original box, packaging material, manuals, accessories or any return not in like new condition. Call for return authorization before sending any return. Customer pays for all freight on returns. Special order returns on a case-by-case basis only.

WARRANTIES – The customer is responsible for any freight or labor costs regarding warranty repair or replacement. All products carry the manufacturer warranties and are the sole responsi-bility of the manufacturer. Claims for damages, expenses or lost time resulting from the use or failure of any product sold by or through us are not allowable. Etowah Valley Equipment, Inc. offers no other warranties or representations of any kind, expressed or implied. Due to the nature of our products Etowah Valley Equipment, Inc. assumes no liability whatsoever for the installation and or use of any product sold by or through us. Etowah Valley Equipment, Inc. will not be responsible for any special, consequential or incidental damages resulting from the pur-chase, installation, use or improper functioning of this equipment regardless of the cause. Such damages include, but are not limited to, loss of revenue or profit, downtime costs, loss of use, cost of substitute equipment, facilities or services, or claims of your customers for such damage.

TECHNICAL SUPPORT – Any technical support provided to the buyer will be without charge. Etowah Valley Equipment, Inc. assumes no liability or obligation for any results of said advice whether oral or written. The buyer shall have sole responsibility for the selection and use or any equipment or supplies.
